These terms apply to all contracts and agreements between Trust-KYC Partners (“Provider”) and individuals or companies that refer users for identity verification (KYC) (“Partner”).
Deviating terms of the Partner apply only if the Provider has agreed to them expressly in writing.
The subject matter is the referral of suitable users to the Provider for a defined onboarding and KYC process. The Provider carries out the operational handling with the user. The Partner provides the first contact or referral as contractually agreed.
The Partner informs the referred user truthfully about the purpose of the referral. It is prohibited to acquire users by misrepresentation or to transmit third-party data without consent.
The Partner refrains from actions that violate applicable law or the Provider’s policies.
Compensation per successfully completed referral is agreed individually with the Partner and applies only after written confirmation by the Provider (email is sufficient). Compensation is due only after provably successful completion of the agreed process.
Payouts follow the deadlines and methods agreed with the Partner (e.g. bank transfer, cryptocurrency, PayPal). The Partner provides correct payment details. Third-party fees (e.g. bank, network) may be borne by the Partner unless otherwise agreed.
The Provider is fully liable for intent and gross negligence. Otherwise the Provider is liable only for breach of material obligations and limited to typically foreseeable damage. Liability for indirect damage or lost profit is excluded where permitted by law.
Unless otherwise agreed, either side may terminate cooperation with reasonable notice. Compensation claims from already completed cases remain unaffected.
German law applies to the exclusion of the UN Sales Convention. Venue is, where permissible, the Provider’s registered office as stated in the legal notice.
If individual provisions are invalid, the remainder stays in effect. Invalid provisions are replaced by what is legally permissible.
